Withdraw from contract

You can use this page to submit an online withdrawal declaration for an eligible order placed with Foliage Factory.

This online function is an additional way to exercise your statutory right of withdrawal. You can still contact us by email, by post, or use any other legally accepted withdrawal method.

A. Instructions for withdrawal

Introduction

Consumers, meaning any individual acting for purposes that are wholly or mainly outside that individual’s trade, business, craft or profession, are entitled to withdraw from a contract under the following conditions.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period will expire fourteen days after the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods.

If several goods were ordered in one order and delivered separately, the withdrawal period will expire fourteen days after the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the last good.

If goods are delivered in several lots or pieces, the withdrawal period will expire fourteen days after the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the last lot or piece.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by a clear statement, for example by letter or email:

After entering the required information, you can submit your withdrawal declaration by clicking “Confirm withdrawal”. If you use this option, we will send you an electronic acknowledgement of receipt without undue delay.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery, except for any supplementary costs arising if you chose a delivery type other than the least expensive standard delivery offered by us.

We will make the reimbursement without undue delay and no later than fourteen days after the day on which we are informed about your decision to withdraw from this contract.

We may make a deduction from the reimbursement for any loss in value of the goods supplied if the loss results from handling by you that was not necessary to establish the nature, characteristics and functioning of the goods.

We will make the reimbursement using the same means of payment that you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is earliest.

You must send back the goods or hand them over to us without undue delay and in any event no later than fourteen days from the day on which you inform us that you are withdrawing from this contract. The deadline is met if you send back the goods before the fourteen-day period has expired.

You will bear the direct cost of returning the goods if you withdraw from the contract because you changed your mind.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Damaged, faulty or incorrect items

This cancellation policy applies to statutory withdrawal. If your order arrived damaged, faulty, incorrect or incomplete, please contact us separately so we can review the issue and provide the appropriate solution.

For approved claims involving a confirmed fault, transport damage, wrong item or another issue accepted by us, we will provide a prepaid return option or reimburse the necessary return costs after approval.

Exclusion and premature expiration of the right of withdrawal

The right of withdrawal is excluded for contracts for the supply of goods that are liable to deteriorate or expire rapidly.

The right of withdrawal is also excluded for contracts for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

The right of withdrawal does not apply to consumers who, at the time of concluding the contract, are not nationals of a member state of the European Union and whose exclusive residence and delivery address are located outside the European Union.

General return information

1. Please prevent damage to and contamination of the goods. If possible, return the goods in their original packaging with all accessories and packaging components.
2. If you no longer have the original packaging, please use suitable packaging that provides adequate protection against transport damage.
3. Please do not return goods freight collect or without sufficient postage.
4. Please contact us before sending a return so we can confirm the correct return address and assign the return to your order. This helps us process your refund faster and prevents parcels from being sent to the wrong location.
5. Please use a tracked shipping service and keep the proof of postage until your refund has been completed.
6. The general return information above is not a precondition for effectively exercising your right of withdrawal.
