1. Plant Delivery, Arrival Issues & Returns

We pack and dispatch live plants with care. Because plants are sensitive products, their condition can be influenced by handling, transit time, weather, and, where applicable, customs procedures. Shipping schedules, destination notes, tracking rules, remote-area surcharges, and customs information are listed on our Shipping & Delivery page.

If your order arrives with clear damage, appears incorrect, or items are missing, please contact us as soon as possible with photos of the plant, close-ups of the issue, and the packaging. We will assess the case and, where applicable, offer an appropriate remedy in line with our Returns & Refunds policy.

2. Refusal of Service

Where legally permitted, we may refuse new orders, cancel and refund orders, or block future purchases in cases of suspected abuse, false claims, fraud, or misuse of our guarantee or refund process. This may include repeated unfounded damage reports, refusal to return goods while demanding compensation, or attempts to obtain refunds, replacements, or discounts through misleading information.

This does not limit mandatory consumer rights or valid claims under applicable law.

3. Failed Delivery, Address Errors and Collection Delays

Customers are responsible for providing complete and accurate delivery details and for responding to courier notifications in time. If delivery fails or is delayed because the address provided was incorrect or incomplete, the parcel was refused, the customer was unavailable despite a delivery or collection opportunity, or the parcel was not collected within the carrier’s collection period, resulting plant deterioration may not be eligible for refund or replacement.

This does not limit mandatory consumer rights where goods are lost, damaged, or delayed for reasons within the responsibility of the seller or carrier before successful delivery.

4. Product Information

Descriptions and care information reflect typical specimens. Natural variation in size, appearance, colour, leaf shape, variegation, and growth can occur. Product images show representative plants or batches where applicable. Measurements are approximate guidelines.

5. Plant Care Guidance

Care guidance is general and cannot guarantee identical results in every home, greenhouse, cabinet, or growing setup. Plant performance depends on light, humidity, temperature, watering, substrate, ventilation, pest pressure, and the customer’s ongoing care after delivery.

6. Health and Safety

Some plants may be toxic if ingested or may irritate skin, eyes, or mucous membranes. Keep plants out of reach of children and pets unless you know the plant is safe for your household. Wash hands after handling, especially after pruning or contact with sap. Customers are responsible for safe placement and handling. We are not liable for allergic reactions, irritation, ingestion, or other adverse effects caused by plant handling or exposure.

7. Prices and Availability

Prices, stock levels, product availability, product names, and product details may change without prior notice. We may update, modify, or discontinue products at any time.

8. Payments

Payments are processed securely by third-party payment providers. We do not store full payment card details on our own systems. Accepted payment options and checkout security information are listed on our Payment Methods page.

For payment-processing issues, chargebacks, failed payments, or provider-specific account questions, your payment provider may also need to be contacted. This does not affect our responsibility for valid refunds owed under our policies or mandatory consumer law.

9. Translations

Translations are provided to make our information easier to understand. If wording differs between language versions, the contract information shown at checkout and included in the order confirmation is decisive for the specific order, without limiting mandatory consumer rights.

10. Website Content and External Links

We are responsible for our own website content in accordance with applicable law. We review our content with care, but errors, omissions, or outdated information may occur. If we become aware of unlawful or incorrect content, we will review it and, where necessary, remove or correct it without undue delay.

Our website may contain links to external websites. We have no control over third-party content and are not responsible for information provided on external websites. Responsibility for external content lies with the respective provider. If we become aware of unlawful external content, we will remove the relevant link without undue delay.

11. Force Majeure

We are not liable for delays, non-performance, or damage caused by circumstances beyond our reasonable control. This may include severe weather, natural disasters, pandemics, government actions, strikes, transport disruptions, customs delays, supply disruptions, or technical failures outside our control. We will communicate relevant delays where possible and resume affected obligations as soon as reasonably feasible.

12. Applicable Law and Jurisdiction

German law applies. Mandatory consumer protection rules of the customer’s habitual residence remain unaffected where they apply. Place of jurisdiction is Germany where legally permitted.

13. Intellectual Property and Copyright

Unless otherwise stated, all images, photographs, text, graphics, logos, and other website content are owned by Foliage Factory or used with permission. Some product photos may be supplied by partners and used with permission. Licensed stock photography may be used under valid licenses.

Any reproduction, distribution, editing, publication, or use beyond statutory allowances requires prior written permission. Third-party copyrights are respected and identified where applicable. If you suspect that content on this website infringes your rights, please contact us so we can review the matter and act promptly where necessary.
